Well it looks like Rihanna has won her lawsuit against Topshop.
A few months ago it was revealed that Rihanna was launching a £5 million lawsuit against the company after they used an image of her face on a T-shirt without permission.
The judge decided that Rihanna fans were likely to be confused by the T-shirt and to feel as if the shirt had been authorised by Rihanna herself. Which it hadn't.
“[Rihanna fans] will recognize or think they recognize the particular image of Rihanna, not simply as a picture of the artist, but as a particular picture of her associated with a particular context, the recent ‘Talk That Talk’ album,” said Judge Birss. “For those persons, the idea that it is authorized will be part of what motivates them to buy the product… Many will buy a product because they think she has approved of it.”
Topshop are suitably pissed off about this.
“We feel that the fact that Rihanna has shopped, worn and had a relationship with Topshop for several years appears to have been detrimental to our case. We robustly dispute the Judge’s conclusion. We beleive that our customers clearly understand when we are undertaking a collaboration such as the one we created with Kate Moss over several seasons.”
The thing is, who cares when buying a T-shirt if it has been endorsed by the celebrity in question? I think people are more likely to be concerned about if it looks good or not more then the legal aspect involved.
